Available in PDF, EPUB and Kindle. Book excerpt: Notions such as complicity, accessory liability, as well as aiding and abetting frequently appear in international criminal law. This study focuses on the relevant legal issues concerning secondary liability as a mode of individual criminal responsibility. The first section of the book looks into the distinction between primary and secondary liability, the nature of secondary liability, and the approaches to prevent secondary liability from being over-inclusive. Additional sections analyze the body of law that has been shaped by the trials conducted in the aftermath of World War II, the trials that have emerged from the ad hoc tribunals for the crimes committed in the former Yugoslavia (ICTY) and Rwanda (ICTR), and the trials which has been created by the EU Member States to the Rome Statute of the International Criminal Court (ICC). The main questions asked are: How does secondary liability relate to a system of perpetration and participation? How is it distinguished from other modes of liability? What are its actus reus and mens rea elements? Particular emphasis has been laid on the substantial and direct effect requirements, as well as on the notion of purposive facilitation. Book excerpt: This research focuses on the concept of participation to the commission of a crime by way of omission. It submits that whereas it is established that certain omissions are settled in international law and could trigger the individual criminal responsibility of the accused, for instance under the principle of command responsibility and inaction under duty to act, no other principle of international law could justify the criminalization of any other omission as it was held in the Rutaganira case. The Rutaganira Judgement which is the appendix to this work has been reprinted in this book.

Book excerpt: In Aiding and Abetting, the doyenne of literary satire has written a wickedly amusing and subversive novel around the true-crime case of one of England’s most notorious uppercrust scoundrels and the “aiders and abetters” who kept him on the loose. When Lord Lucan walks into psychiatrist Hildegard Wolf’s Paris office, there is one problem: she already has a patient who says he’s Lucan, the fugitive murderer who bludgeoned his children’s nanny in a botched attempt to kill his wife. As Dr. Wolf sets about deciding which of her patients, if either, is the real Lucan, she finds herself in a fierce battle of wills and an exciting chase across Europe. For someone is deceiving someone, and it may be the good doctor, who, despite her unorthodox therapeutic method (she talks mainly about her own life), has a sinister past, too. Exhibiting Muriel Spark’s boundless imagination and biting wit, Aiding and Abetting is a brisk, clever, and deliciously entertaining tale by one of Britain’s greatest living novelists.

Book excerpt: Judge Mettraux's four-volume compendium, International Crimes: Law and Practice, will provide the most detailed and authoritative account to-date of the law of international crimes. It is a scholarly tour de force providing a unique blend of academic rigour and an insight into the practice of international criminal law. The compendium is un-rivalled in its breadth and depth, covering almost a century of legal practice, dozens of jurisdictions (national and international), thousands of decisions and judgments and hundreds of cases. This first volume discusses in detail the law of genocide: its definition, elements, normative status, and relationship to the other core international crimes. While the book is an invaluable tool for academics and researchers, it is particularly suited to legal practitioners, guiding the reader through the practical and evidential challenges associated with the prosecution of international crimes.

Download Incitement on Trial PDF by Richard Ashby Wilson Full Free and published by Cambridge University Press. This book was released on 2017-08-18 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: International and national armed conflicts are usually preceded by a media campaign in which public figures foment ethnic, national, racial or religious hatred, inciting listeners to acts of violence. Incitement on Trial evaluates the efforts of international criminal tribunals to hold such inciters criminally responsible. This is an unsettled area of international criminal law, and prosecutors have often struggled to demonstrate a causal connection between speech acts and subsequent crimes. This book identifies 'revenge speech' as the type of rhetoric with the greatest effects on empathy and tolerance for violence. Wilson argues that inciting speech should be handled under the preventative doctrine of inchoate crimes, but that once international crimes have been committed, then ordering and complicity are the most appropriate forms of criminal liability. Based in extensive original research, this book proposes an evidence-based risk assessment model for monitoring political speech.

Download Individual Criminal Responsibility in International Law PDF by Elies van Sliedregt Full Free and published by OUP Oxford. This book was released on 2012-03-01 with total page 376 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the concept of individual criminal responsibility for serious violations of international law, i.e. aggression, genocide, crimes against humanity and war crimes. Such crimes are rarely committed by single individuals. Rather, international crimes generally connote a plurality of offenders, particularly in the execution of the crimes, which are often orchestrated and masterminded by individuals behind the scene of the crimes who can be termed 'intellectual perpetrators'. For a determination of individual guilt and responsibility, a fair assessment of the mutual relationships between those persons is indispensable. By setting out how to understand and apply concepts such as joint criminal enterprise, superior responsibility, duress, and the defence of superior orders, this work provides a framework for that assessment. It does so by bringing to light the roots of these concepts, which lie not merely in earlier phases of development of international criminal law but also in domestic law and legal doctrine. The book also critically reflects on how criminal responsibility has been developed in the case law of international criminal tribunals and courts. It thus illuminates and analyses the rules on individual responsibility in international law.

This book was released on 2021-12-17 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: "War crimes, crimes against humanity, genocide and the crime of aggression (so-called 'core crimes') often could not be committed without financial assistance. This book examines the basis for individual criminal liability under international law for persons who finance core crimes. Despite the need for clear rules, neither international courts nor scholars agree upon whether or not, or under what circumstances, such liability exists. To determine the minimum standard of liability, this work analyses the legal rules relating to complicity, both under international criminal law and domestically in twenty selected jurisdictions in Africa, Asia, Europe, Latin America, North America and Oceania. The aim of these analyses is to determine whether there are general principles of law recognised by the community of States regarding the minimum standard of liability for aiders and abettors. This book proposes a comparative framework for assessing legal rules relating to complicity, and it advances a normative claim as to how legal rules should be structured concerning the criminal responsibility of individuals who finance the commission of core crimes. The analysis of the applicable international law and the comparative analysis of national jurisdictions lead to the conclusion that, currently, the minimum standard of knowledge for aiding and abetting is active knowledge. However, the author argues that this standard should be revised to include wilful blindness. Regarding the intent requirement, the analyses find that dolus eventualis is included in the definition of intent"--

Download The Despot's Accomplice PDF by Brian Klaas Full Free and published by Oxford University Press. This book was released on 2018-05-01 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: For the first time since the end of the Cold War, the world is steadily becoming less democratic. The true culprits are dictators and counterfeit democrats. But, argues Klaas, the West is also an accomplice, inadvertently assaulting pro-democracy forces abroad as governments in Washington, London and Brussels chase pyrrhic short-term economic and security victories. Friendly fire from Western democracies against democracy abroad is too high a price to pay for a myopic foreign policy that is ultimately making the world less prosperous, stable and democratic. The Despot's Accomplice draws on years of extensive interviews on the frontlines of the global struggle for democracy, from a poetry-reading, politician-kidnapping general in Madagascar to Islamist torture victims in Tunisia, Belarusian opposition activists tailed by the KGB, West African rebels, and tea-sipping members of the Thai junta. Cumulatively, their stories weave together a tale of a broken system at the root of democracy's global retreat.
